The HHS recently announced specific instructions for submitting a notice of a breach to the Secretary. Per the new breach notification regulation, all PHI breaches under a covered entity must be reported to the HHS Secretary; and in cases where it affects more than 500 individuals, it must be also reported to the media.

As expected, the HHS announced on August 19th the details behind a new regulation requiring healthcare providers, health plans and other entities under HIPAA to notify individuals when their individual health information has been breached.

The FTC announces it has extended the compliance deadline for the 'Red Flags' Rule or Identity Theft Policy from August 1, 2009 to November 1, 2009. The FTC granted this extension to give "creditors" and "financial institutions" additional time to review the Rule and determine what they must do to comply.
