HIPAA outlines that a record of certain disclosures of protected health information must be provided to patients upon their request and each disclosure must include the following elements:
- The date of the disclosure;
- The name, and if known, address of the recipient of PHI;
- A brief description of the health information disclosed; and
- The brief statement of the purpose of the disclosure.
The types of accounting of disclosures that may be required to be included in an accounting of disclosures include disclosures (this is not an exhaustive list):
- That are required by law;
- Made for public health purposes (i.e., vital statistics, communicable disease reports, etc.);
- Made as a result of a Court orders or subpoenas;
- About victims of abuse, neglect, or domestic violence;
- For health oversight purposes;
- Made to law enforcement;
- Made to Coroners, Medial Examiners, or Funeral Directors;
- Made to the FDA for purposes related to the quality, safety, or effectiveness of a FDA-regulated product or activity;
- For cadaveric organ, eye or tissue donation and transplantation purposes; and
- For human-subject research that does not obtain a subjects authorization
Furthermore, HIPAA requires that disclosures, subject to the accounting of disclosures requirement, made by a business associates also be included in an entity's accounting of disclosures report to patients.
A patient has the right to receive an accounting of disclosures free of charge every 12 months.
